§ 1 [General Provisions]

  1. These terms and conditions define the rules for using the online store available at: https://alasta.co.uk by its Users, as well as the terms, types, and scope of services provided, along with the complaint procedure.
  2. The owner of the website is Alasta spółka z ograniczoną odpowiedzialnością, with its registered office at Niałek Wielki 106, 64-200 Wolsztyn, Poland, Wielkopolskie Voivodeship, entered into the National Court Register by the District Court in Poznań – Nowe Miasto and Wilda, IX Commercial Division, under KRS number: 0000771908, REGON: 382569333, NIP: 9231732328, with a fully paid share capital of PLN 18,000.00.

 

§ 2 [Definitions]

For the purposes of these terms and conditions, the following definitions apply:

  1. SellerAlasta spółka z ograniczoną odpowiedzialnością, with its registered office at Niałek Wielki 106, 64-200 Wolsztyn, Poland, Wielkopolskie Voivodeship, entered into the National Court Register by the District Court in Poznań – Nowe Miasto and Wilda, IX Commercial Division, under KRS number: 0000771908, REGON: 382569333, NIP: 9231732328, with a fully paid share capital of PLN 18,000.00.
  2. Online Store – the website available at https://alasta.co.uk, through which the Seller offers products for sale via shipping or personal collection upon arrangement with the Seller.
  3. User/Customer – a natural person (Consumer) or Entrepreneur who, through access to the Online Store, uses its functionalities.
  4. User Account – an individual User account enabling access to the Online Store, which the User logs into using the email address or username and password provided during registration.
  5. Consumer – a natural person entering into a legal transaction with the Seller not directly related to their business or professional activity.
  6. Entrepreneur – a natural person, legal person, or organizational unit without legal personality granted legal capacity by law, conducting business or professional activity in their own name.
  7. Registration – the act of creating a User account, accepting these terms and conditions, and entering into an Agreement.
  8. Order Placement – the legal act of entering into an Agreement with the Seller.
  9. Agreement – a sales agreement concluded electronically between the Seller and the User, whereby the Customer agrees to pay for a selected product, and the Seller agrees to transfer its ownership and deliver it.
  10. Electronic Service – the provision of services electronically as defined by the Act on Electronic Services (Polish Journal of Laws 2020, item 344, as amended), by the Seller to the User via the Online Store.
  11. Privacy Policy – the privacy and cookie policy available at the provided link.
  12. Terms and Conditions – these “Alasta Online Store Terms and Conditions.”

 

§ 3 [Technical Requirements for Using the Online Store]

  1. To use the Online Store, the User must have:
  1. A computer equipped with the Microsoft Windows or iOS operating system, or a smartphone or tablet with an appropriate operating system.
  2. Continuous access to the Internet.
  3. An updated web browser from at least 2017: Mozilla Firefox, Microsoft Edge, Google Chrome, or Opera, supporting technologies such as HTTP, HTTPS, HTML5, XHTML, XML, CSS3, JavaScript, with enabled cookies and support for images in formats like JPEG, PNG, GIF, and SVG.
  4. An email account.

§ 4 [User and User Account Usage]

  1. To create a User Account in the Online Store, the following registration process must be completed: a. Provide a username and email address.
    b. Accept reCAPTCHA verification.
    c. Agree to these Terms and Conditions and the Privacy Policy and consent to the processing of personal data.
  2. Before placing an order, the User is required to provide accurate account information, including their first and last name, address, and for business-related purchases, the company name and VAT number (NIP).
  3. By accepting these Terms and Conditions, the User declares that all information provided for the execution of the Agreement is true, accurate, and obtained legally, and the User has the right to use such data.

 

  1. A User with an Account may at any time:
  1. Change their password.
  2. Modify entered personal data.
  3. View order history.
  4. Add payment cards to their Account for completing orders.
  5. Delete their User Account.

 

§ 5 [Order Placement and Agreement Conclusion]

  1. Through the Online Store, the Seller sells goods produced by them, including shipping to the address provided by the User, as per § 6.3 of these Terms and Conditions.
  2. The order placement process occurs entirely through the website and includes the following steps: a. The User selects a product of interest and adds it to their shopping cart.
    b. If necessary, the User may be prompted to select additional features or parameters of the product, with the total cost displayed before adding the product to the cart. All prices in the Online Store include VAT.
    c. After adding the product to the cart, the User is redirected to a page where they can adjust the quantity, provide the required data as specified in § 4.2 of these Terms and Conditions, or log in to their User Account.
    d. After completing these steps, the User selects a payment method, confirms their acknowledgment of these Terms and Conditions, the right to withdraw from the Agreement, and completes the payment.
  3. Available payment methods for purchased goods: a. Via the payment operator PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, Wielkopolskie Voivodeship, KRS: 0000347935, NIP: 779-236-98-87.
    b. Using a payment card (credit or debit, Visa, Mastercard, or American Express).
    c. By bank transfer to the Seller’s account. In this case, after placing the order, the User will receive an email with payment details. The order number must be included in the transfer title for quicker identification.
    d. Cash on delivery for orders within Poland only.
  4. Upon completing payment, the Agreement between the Seller and the User is concluded, valid for the duration necessary to fulfill the order. The User will receive an email confirming the order and Agreement.
  5. Upon the conclusion of the Agreement and payment, the Seller is entitled to issue electronic accounting documents (e.g., invoices) to the User’s provided email address. The User agrees to receive such invoices electronically.

 

§ 6 [Delivery of Goods]

  1. Delivery costs must be added to the product prices unless stated otherwise. Shipping within Poland is free. For shipments to other EU member states or the UK, the shipping cost will be provided before payment is completed.
  2. For courier shipments, all orders will be dispatched to the Customer within 2 to 20 business days from payment confirmation, depending on the product category.
  3. Deliveries are made to the following countries: Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Greece, Spain, the Netherlands, Ireland, Lithuania, Germany, Norway, Poland, Czech Republic, Romania, Sweden, Slovakia, Slovenia, Hungary, Italy, the United Kingdom, and Latvia.
  4. When the Agreement is concluded with a Consumer, the Seller assumes full responsibility for the shipment until it is handed over to the User by the courier. If the goods arrive with visible transport damage, the User should report the issue to the courier and notify the Seller as soon as possible. Delays in reporting or contacting the Seller do not negatively affect the User.
  5. When the Agreement is concluded with an Entrepreneur, the Seller’s liability for loss, damage, or delay of the goods ends upon handing them over to the courier.
  6. Upon receipt of the shipment, the customer is obliged to carefully check the condition of the packaging and contents in the presence of the courier. If any damage to the packaging or product is found, the shipment must be immediately refused and a damage report must be prepared in accordance with the carrier’s procedures. The absence of such a report may prevent the processing of the complaint regarding the damaged shipment.

  8. A thorough check of the shipment upon receipt is necessary to protect your rights in case of a complaint.

 

§ 7 [Right of Withdrawal from the Agreement]

  1. A Consumer who has entered into an Agreement with the Seller through the Online Store may withdraw from it within 14 days without providing any reason and without incurring additional costs, except for the costs related to returning the goods to the Seller.
  2. The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal to the Seller. The declaration can be submitted using a form, a sample of which is available at this link.
  3. The declaration of withdrawal can be submitted as follows:
    a. By sending an electronic declaration to the email address: shop@alasta.co.uk. To meet the deadline, it is sufficient to send the declaration before the expiration of the withdrawal period.
    b. By sending a signed declaration directly to the Seller’s address:
    Alasta sp. z o.o., Niałek Wielki 106, 64-200 Wolsztyn, Poland, Wielkopolskie Voivodeship. To meet the deadline, it is sufficient to dispatch the declaration before the expiration of the withdrawal period.
  4. Upon the Consumer’s exercise of the right to withdraw, the Agreement shall be considered null and void.
  5. The Seller shall promptly, and no later than within 14 days of receiving the Consumer’s declaration of withdrawal, refund all payments made by the Consumer, except for the delivery costs, which the Consumer bears.
  6. The refund will be made using the same payment method as used by the Consumer unless the Consumer explicitly agrees to another refund method, which incurs no costs for the Seller.
  7. The Consumer is obligated to return the goods to the Seller within 14 days from the date of withdrawal from the Agreement. To meet the deadline, it is sufficient to send the goods before the 14-day period expires.
  8. The Consumer is responsible for any reduction in the value of the goods resulting from their use beyond what is necessary to ascertain the nature, features, and functioning of the goods.
  9. The Consumer is not entitled to withdraw from the Agreement as described above in cases where the ordered goods were:
    a. Custom-made or produced according to the Consumer’s specifications, or
    b. Clearly tailored to satisfy the Consumer’s individual needs.
  10. The Consumer will be informed before concluding the Agreement and making a payment whether the product will be custom-made according to individual specifications.
  11. The returned product should be in a condition that allows its further sale, meaning the consumer may use the product only in a way necessary to determine its nature, features, and functionality. The product should be complete and, if possible, returned in its original packaging. The product must not be mounted on the wall or show any signs of mounting.
  12. The costs of returning the product are borne by the customer, but in certain cases, the seller may cover the return shipping costs up to the amount of the shipping costs paid during the original transaction.
  13. The customer is obliged to properly pack the returned product in a manner that minimizes the risk of damage during transport.
  14. The seller does not accept return shipments sent by cash on delivery.
  15. The return shipment must include a proof of purchase (e.g., a copy of the receipt or invoice) and the completed return form.

This regulation has been drafted in accordance with the European Union legislation regarding the protection of consumer rights.

 

§ 8 [Non-Conformity of Goods with the Agreement and Complaint Procedure for Agreements with Consumers]

  1. In the event of non-conformity of goods with the Agreement, the Consumer is entitled to the rights specified in this section.
  2. Goods are considered to conform to the Agreement if, in particular, they match the agreed-upon description, type, quantity, quality, completeness, and functionality. Additionally, goods must:
  1. Be suitable for the purposes for which such goods are typically used.
  2. Have qualities and features typical for such goods that the Consumer can reasonably expect based on their nature and the Seller’s assurances.
  1. The Seller is liable for non-conformity existing at the time of delivery and revealed within two years from that moment, except for goods delivered to other EU member states outside Poland or if the Consumer resided in another EU member state at the time of Agreement conclusion, where a longer liability period applies under local law.
  2. If goods are non-conforming with the Agreement, the Consumer may demand their repair or replacement.
  3. The Seller may replace the goods instead of repairing them (or vice versa) if the chosen remedy is impossible or entails excessive costs for the Seller. If repair and replacement are impossible or entail excessive costs, the Seller may refuse to bring the goods into conformity with the Agreement.
  4. Repairs or replacements must be completed within a reasonable time after the Seller has been notified of the non-conformity and without significant inconvenience to the Consumer, considering the nature of the goods and their intended purpose. The Seller bears the costs of repair or replacement, including postal, transportation, labor, and material costs.
  5. The Consumer may request a price reduction or withdraw from the Agreement if:
  1. The Seller refuses to bring the goods into conformity under § 8.5.
  2. The Seller fails to bring the goods into conformity under § 8.6.
  3. The non-conformity persists despite the Seller’s efforts to rectify it.
  4. The non-conformity is substantial enough to justify an immediate price reduction or withdrawal from the Agreement.
  5. It is evident from the Seller’s declaration or circumstances that the goods will not be brought into conformity within a reasonable time or without significant inconvenience to the Consumer.
  1. The Consumer cannot withdraw from the Agreement if the non-conformity is minor.
  2. To file a complaint regarding non-conforming goods, the Consumer must send a written notice to:
    Alasta sp. z o.o., Niałek Wielki 106, 64-200 Wolsztyn, Poland, Wielkopolskie Voivodeship or email shop@alasta.co.uk, specifying:
  1. Consumer’s contact details.
  2. A description of the non-conformity, accompanied by photographic documentation.
  3. The requested resolution under § 8.4 or § 8.7 of these Terms and Conditions.
  1. For clarification on the complaint process, the Consumer may contact the Seller via the following numbers: +48238012767 or +46662872404.
  2. Complaints will be resolved within 14 days of receiving the notice.
  3. The Seller’s response to the complaint will be sent to the Consumer’s email address specified in their account or included in the complaint notice.
  4. If the Consumer withdraws from the Agreement, they must return the goods to the Seller promptly, and the Seller will refund the price within 14 days of receiving the goods.
  5. Refunds will be issued using the same payment method unless the Consumer agrees to another method that does not impose additional costs on the Seller.
  6. Complaints regarding returned goods should be adequately packaged to prevent damage during transport. If damage results from improper handling or packaging during transport, the Seller reserves the right to deny the complaint.

 

§ 9 [Warranty Conditions for Agreements with Entrepreneurs]

  1. Under Article 558 § 1 of the Polish Civil Code, the Seller’s liability under warranty for goods sold to non-Consumer Clients is excluded.
  2. This exclusion also applies to Agreements where the other party is an individual acting for purposes directly related to their business but not falling within their professional activity, as determined by their business profile registered in the Central Registration and Information on Business (CEIDG) database (Article 556⁴ of the Civil Code).

§ 10 [Warranty for Goods]

  1. Goods sold by the Seller are covered by a 2-year warranty.
  2. The Customer may utilize the warranty independently of their rights arising from non-conformity of the goods with the Agreement (complaints).
  3. In cases where the goods are sent to the Seller for warranty purposes, the provisions of §8, point 15 of the Terms and Conditions apply accordingly.
  4. Detailed warranty conditions are specified in the warranty card.

§ 11 [Types and Scope of Electronic Services Provided]

  1. The Seller provides the following free electronic services to Users via the Online Store:
  1. Allowing Users to browse the Online Store’s content, place orders, and conclude Agreements with the Seller,
  2. Maintaining a User Account,
  3. Access to the “Customer Assistance” chat for product advisory services,
  4. Viewing and submitting reviews via the “TrustMate” portal, accessible at http://trustmate.io.
  1. For Users with a registered User Account, the Seller additionally provides functionalities such as:
  1. Viewing order history,
  2. Accessing electronic versions of manuals for purchased goods.
  1. The Seller reserves the right to display advertising content on the Online Store, which forms an integral part of the Online Store.

 

§ 12 [Conditions for Provision and Conclusion of Electronic Service Agreements]

  1. The provision of electronic services outlined in §11 of these Terms and Conditions is free of charge.
  2. The agreement allowing Users to browse the Online Store’s content is concluded for a definite period and terminates once the User stops browsing the content.
  3. The agreement for placing orders and concluding Agreements with the Seller is concluded for a definite period required for order fulfillment.
  4. The agreement for maintaining a User Account is concluded for an indefinite period. Users may delete their User Account at any time through the Online Store.
  5. The agreement for viewing and submitting reviews is concluded for a definite period and terminates once the review is posted or the User ceases to use this service.
  6. The technical requirements necessary to use the Online Store are specified in §3 of the Terms and Conditions.
  7. Users are obliged to use the Online Store in a manner compliant with applicable laws and good practices, with due respect for the personal rights and intellectual property of third parties.
  8. Users must provide accurate data and ensure that they do not submit any unlawful content.

 

§ 13 [Complaint Procedure Related to Electronic Services]

  1. For complaints related to the provision of electronic services, the provisions of §8, points 9-12 of these Terms and Conditions apply accordingly. However, the User should provide as much information and detail about the issue as possible, including the type and date of the occurrence of the irregularity.

§ 14 [Seller’s Liability Scope]

  1. The Seller shall not be liable, particularly for outcomes arising from:
  1. The User’s failure to comply with the Terms and Conditions,
  2. Force majeure or technical failures of the Online Store due to reasons beyond the Seller’s control,
  3. Inaccessibility of the Online Store due to the User’s non-compliance with the technical requirements specified in § 3 of the Terms and Conditions,
  4. Unauthorized access to the User Account by third parties,
  5. Data loss caused by hardware, system failure, or other circumstances beyond the Seller’s control,
  6. Emails from the Seller being flagged as spam.
  1. The Seller reserves the right to conduct technical maintenance breaks to ensure proper functionality of the Online Store.
  2. If the User changes their personal or email details, they must promptly notify the Seller, specifying the extent of changes under the risk of emails sent to the previous address being deemed received.
  3. The Seller shall not be held responsible for lost profits resulting from improper performance or non-performance of the Agreement.

 

§ 15 [Personal Data Protection]

  1. The rules for protecting personal data regarding the Online Store’s operations and the Agreement’s conclusion are defined in the Privacy Policy and Cookies Policy available at this link.
  2. Providing personal data by the User is necessary to perform the Agreement correctly. The Seller does not verify the personal data provided.
  3. The User’s personal data database is legally protected and particularly safeguarded against unauthorized access.

 

§ 16 [Code of Good Practice]

  1. The Seller undertakes to comply with all consumer protection regulations and conduct honest sales in accordance with all applicable legal provisions, particularly those related to distance selling.
  2. These Terms and Conditions have been prepared in an unambiguous manner. In case of any ambiguity regarding a specific provision, its reinterpretation shall always favor the Consumer.
  3. Before concluding the Agreement, the User will be informed of all its essential terms, especially the purchase price.
  4. The Seller makes every effort to process personal data obtained in connection with the order exclusively for its intended purpose and adequately secure it against unauthorized use.
  5. The Seller is committed to providing post-sales support, ensuring that appropriate personnel assist with any issues related to assembly or product usage.

 

§ 17 [Intellectual Property and Copyright]

  1. The Seller holds exclusive rights to content made available or posted within the Online Store, including copyrights, the Online Store’s name, graphic elements, and database rights. These are protected by law and belong to the Seller or entities with whom the Seller has concluded appropriate agreements. Users may use such content free of charge for personal purposes and solely for proper use of the Online Store.
  2. By posting any content within the Online Store, such as graphics, comments, opinions, or statements, the User grants the Seller a non-exclusive, free license to use, record, modify, delete, supplement, publicly perform, publicly display, reproduce, and distribute (especially online) this content.

§ 18 [Final Provisions]

  1. By accepting these Terms and Conditions, the User declares they have understood its contents and agrees to comply with its provisions.
  2. These Terms and Conditions shall come into effect on ________________________.
  3. The Seller reserves the right to amend these Terms and Conditions at any time, with changes effective after notifying Users of the new content via the email address provided during User Account registration.
  4. Agreements concluded by the Seller shall be drafted in Polish or the User’s residence country’s language at the time of the Agreement’s conclusion.

  6. Disputes arising from the Online Store’s operations, provided services, Agreement conclusion, improper performance, or non-performance involving Entrepreneurs shall be resolved by a competent court at the Seller’s registered office. For Consumers who have received goods in an EU country outside Poland or were residing in another EU country upon Agreement conclusion, they may choose a competent court under more favorable local law (local law rights).
  7. Agreements concluded with the Seller are governed by Polish law and meet EU member states’ directive requirements. Applicable law for dispute resolution is Polish law, except for Consumers receiving goods in EU countries outside Poland or residing in other EU countries at the time of the Agreement’s conclusion, where they may choose the more favorable local law.
  8. Should any provision of the Terms and Conditions be inconsistent with applicable law, the relevant provisions of Polish or local EU law apply instead. The choice of applicable law is at the Consumer’s discretion (only applies to Consumer Agreements).
  9. Consumers may resolve disputes out-of-court, particularly by submitting a mediation request or seeking arbitration via a permanent consumer arbitration court. Information is available at https://polubowne.uokik.gov.pl/. Consumers can also seek free assistance from district (municipal) consumer advocates or consumer protection organizations. Such dispute resolution is free.
  10. Consumers (excluding those whose goods were delivered to the UK or were residing there at the time of the Agreement) may also file complaints via the Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/.
  11. These Terms and Conditions are governed by Polish law (with unregulated matters subject to Polish regulations, particularly the Civil Code, Consumer Rights Act, and Act on Electronic Service Provision). The UN Convention on Contracts for the International Sale of Goods is expressly excluded. Consumers residing permanently in an EU member state outside Poland are additionally protected by the mandatory provisions of their home country’s laws at the Agreement’s conclusion. Non-exclusive jurisdiction is determined by the general courts for Wolsztyn, Poland, or the EU member state where the Consumer resides.
